Acceptance of Terms
This Agreement is legally binding between you and Michael Cooper, a sole trader trading as DragonWebHost, OnePoundEmail and MakeMyKB ("the Company," "we," "us," or "our"). These terms govern your use of the websites and services provided under those brands ("Services").
Email: [email protected]
By accessing our websites or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Acceptable Use Policy (AUP).
By agreeing to this Agreement, you warrant and represent that you are at least 18 years of age.
Uptime Policy
We aim to provide 99.9% uptime for web hosting services and 99% uptime for email hosting services, measured on a per-calendar-month basis. Current and historical uptime is published on our status page.
Exclusions: This target excludes downtime resulting from scheduled maintenance, emergency maintenance, or circumstances beyond our reasonable control (including, but not limited to, upstream provider outages, DDoS attacks, or DNS propagation issues).
- If availability of your service falls below its uptime target in a given month, excluding the circumstances above, you may request a pro-rata account credit for the affected service.
- To request a credit, you must submit a support ticket within seven (7) days of the end of the month in which the downtime occurred.
- Credits are applied to your account and are not paid out as cash.
Refunds & Cancellation
14-day money-back guarantee: We offer a 14-day money-back guarantee for new, non-promotional hosting and email packages. To request a refund, contact our support team within 14 days of your initial purchase.
Your statutory right to cancel: If you are a consumer, you also have a legal right to cancel a new service within 14 days of ordering. If you asked us to start providing the service during those 14 days, which happens automatically when your service is set up, we may deduct a proportionate amount for the service provided up to the date you cancel.
Domain names: A domain registration, renewal or transfer is completed once it has been processed by the registry, and is non-refundable from that point.
Digital downloads: Downloadable products from MakeMyKB, including knowledgebase files, are supplied immediately after purchase. By completing your order you expressly consent to immediate access and acknowledge that you lose your right to cancel once the download is made available.
Cryptocurrency payments: Any refund of a cryptocurrency payment is made at the GBP value shown on the original invoice, not the value of the cryptocurrency at the time of refund.
Promotional Packages
From time to time we offer promotional packages, such as seasonal or Black Friday deals. Unless the offer states otherwise, the following applies to all promotional packages:
- Promotional packages are excluded from the 14-day money-back guarantee in Section 3. Your statutory right to cancel is not affected.
- Where an offer states that it renews at the same price, that price is locked for as long as the service remains active and paid.
- The promotional price is permanently lost if the service is cancelled, or is terminated for non-payment. It cannot be reinstated or transferred to another service.
- Promotional packages cannot be upgraded or downgraded while keeping promotional pricing, and existing services cannot be converted to promotional pricing.
- Offers are limited to one per customer and are available while stock lasts. We may refuse or cancel orders placed using duplicate accounts.
- Promotional packages are subject to the same Acceptable Use Policy and resource limits as all other Services.
Account Security
You are responsible for maintaining the security of your account, including the use of strong, unique passwords and regularly updating them. Enabling two-factor authentication (2FA) is strongly recommended where available.
You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorised use of your account or any other breach of security. We are not liable for any loss caused by your failure to keep your account secure.
Providing false contact information of any kind may result in the immediate termination of your account.
Acceptable Use Policy
Users of our Services agree not to engage in any illegal activities, resource abuse, or spam.
All Services
The following are prohibited on all Services:
- Engaging in any form of illegal activity, including but not limited to copyright infringement, child exploitation, and distribution of malware.
- Any attempt to undermine or cause harm to our servers or to other customers.
- Abuse of server resources, including excessive CPU usage, memory usage, and disk space consumption. Where possible we will contact you with options to reduce usage before taking action, but abusive processes may be stopped immediately.
- Leak forums, or any forum or community that shares and/or trades compromised accounts or personal data.
- Adult forums, or any forum or community that shares and/or trades pornographic material.
- Counterfeit goods websites.
- Redistributing, reselling, or publicly sharing downloadable content or knowledgebase files provided via MakeMyKB without prior written consent.
Email Services
The following additionally apply to our email hosting services, including OnePoundEmail:
- Sending unsolicited email (spam).
- Sending marketing email of any kind, regardless of opt-in status. This includes newsletters, promotions and sales campaigns.
- Sending to a mailing list of any kind unless every recipient has joined through a double opt-in process, meaning they signed up and then confirmed their email address. Non-marketing lists only, such as club, community or service announcements.
- Using instantly.ai, or any similar cold outreach service, in connection with our Services.
- Use in connection with dropshipping services.
- Anything relating to v2board.
- Sending hundreds of emails at a time to @qq.com addresses.
- Deceptive use against third party services, such as creating multiple email accounts or using a catch-all with randomly generated aliases to pose as multiple users.
- Bulk forwarding for large numbers of domains on one account.
- Email forwarders configured so that they frequently exceed 400 outbound emails per hour.
- Sending SMS messages via email.
- Using "warmup" services.
- Sending DMARC reports through our Services.
- Sending an excess of automated emails that are not intended for human consumption to third party email services.
- Engaging in activities that lead to IP address reputation damage.
- Spoofing "From" headers to display a third party or domain that you do not own or manage.
- Adding domains to our system that are not legitimate, not managed by you or your clients, or related to any spam/scam activity. This includes lookalike or misspelled domains intended to make recipients think you represent a domain you do not control.
- Sending through our outbound email service without valid SPF and MX records.
- Creating additional email accounts to get around the 400 outbound emails per hour limit, which applies to each account unless agreed with us in writing beforehand.
- Storing website files, databases, or other media that are not related to email inside email hosting packages.
How We Protect Email Delivery
- Spam reports: If a recipient reports your email as spam and we are made aware of it, outbound email to that address will be blocked. To have it unblocked, you will need to resolve the issue with the recipient and then contact us.
- Invalid recipients: If you repeatedly send email to invalid or unroutable addresses, those addresses may be added to public spam filter lists.
- Account security: You are responsible for using strong passwords on your email accounts. Repeatedly compromised accounts that damage our sending reputation may result in termination.
Payment & Renewals
We accept PayPal, debit/credit cards, cryptocurrency, and UK bank transfer. Services are billed in advance for the billing period you choose.
- Renewals: Services renew automatically at the end of each billing period at the price shown in your client area, unless you cancel before the renewal date. If you have a saved payment method, it will be charged automatically.
- Price changes: We will give you at least 30 days' notice by email of any increase to the renewal price of an existing service. You may cancel before the increase takes effect.
- Non-payment: If a renewal invoice is unpaid, we will send payment reminders. If it remains unpaid after the final reminder, the service will be suspended. A service that is still unpaid 14 days after suspension will be cancelled, and its data may be permanently deleted.
Website Migrations
We offer free migration of websites and email to new hosting accounts, subject to the following:
- Free migrations cover websites and email moved from hosts using cPanel, DirectAdmin or Plesk, up to the number of websites included in your plan.
- Migrations must be requested within 30 days of your first order for the service.
- You must provide working login details for your current host, or a full backup, and confirm that you are authorised to give us access.
- Migrations from other platforms, custom server setups, or very large sites or mailboxes are carried out on a best-effort basis, or may be quoted separately.
- We take reasonable care during every migration. You must keep your existing hosting and your own copy of your data until you have checked that everything has moved correctly.
Reseller Hosting
- Account limits: Where a reseller plan includes unlimited client accounts, the number of accounts is not capped, but all accounts together must stay within the plan's storage, inode and resource limits and this Agreement.
- Your clients: You are responsible for your clients' use of the Services. Any breach of this Agreement by one of your clients is treated as a breach by you.
- Enforcement: We may suspend or terminate an individual client account that breaches this Agreement, without suspending your whole reseller account where that can be avoided.
- Support: We provide support to you, the reseller. You are responsible for supporting your own clients. We do not provide support directly to your clients.
- White-label: You may sell the Services under your own brand. You must not represent your clients' services as being provided by DragonWebHost unless we have agreed to this in writing.
Domain Names
- Domain registrations are subject to the rules of the relevant registry and authority, such as ICANN or Nominet, in addition to this Agreement.
- You are responsible for renewing your domains on time. We will send renewal reminders to your account email address, but failure to receive a reminder does not extend a domain's expiry date.
- Expired domains may enter a redemption period, during which the registry charges an additional redemption fee to restore them. After that period, a domain may be released for anyone to register.
- You must provide accurate registrant contact details. Inaccurate details may lead to a domain being suspended by the registry.
- You may transfer a domain away from us at any time, subject to registry rules.
Support Policy
Support enquiries should be submitted via email or our support ticket system. We aim to address high-priority issues (outages/system failures) within 24 hours, but we do not guarantee specific response times.
Data & Backups
We take regular backups of hosting accounts, but we do not guarantee their availability or integrity. You are responsible for keeping your own copies of your data and important files. Subject to Section 14, we are not liable for loss of data.
Intellectual Property & Digital Products
All content provided through the Services, including but not limited to MakeMyKB knowledgebase files, is the intellectual property of Michael Cooper. You may not reproduce, distribute, or create derivative works based on our content without prior written consent, except as permitted by the licence for a product you have purchased.
Limitation of Liability
Nothing in this Agreement limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
Subject to the above, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, business, data or goodwill, arising out of or related to your use of the Services.
Subject to the above, our total liability to you in connection with the Services is limited to the total amount you have paid us in the 12 months before the event giving rise to the claim.
Indemnification
You agree to indemnify Michael Cooper against any third-party claims, damages, losses, and reasonable expenses, including legal fees, arising out of your breach of this Agreement or your unlawful use of the Services.
Termination & Changes
Termination by you: You may cancel any service at any time from your client area. Cancellation takes effect at the end of the current billing period unless you request immediate cancellation. Refunds are only given as set out in Section 3.
Termination by us: We may suspend or terminate a service immediately if you breach this Agreement. We may also end a service for any other reason by giving you at least 30 days' notice by email, in which case we will refund any prepaid amount for the unused part of your billing period.
Changes to these terms: We may update these Terms of Service from time to time. We will email you at least 30 days before any significant change takes effect. If you do not accept a change, you may cancel the affected service before it takes effect and receive a pro-rata refund of any prepaid amount for the unused part of your billing period.
Governing Law & Your Statutory Rights
These Terms of Service are governed by the law of England and Wales, and disputes are subject to the jurisdiction of the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
If you are a consumer, nothing in this Agreement affects your statutory rights.
