Section 01

Acceptance of Terms

This Agreement is legally binding between you and Michael Cooper, a sole trader doing business as DragonWebHost ("the Company," "we," "us," or "our"). These terms govern your use of the websites and services provided under the brands DragonWebHost, OnePoundEmail, and MakeMyKB ("Services").

By accessing our websites or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Acceptable Use Policy (AUP).

By agreeing to this Agreement, you warrant and represent that you are at least 18 years of age.

Important: We reserve the right to suspend or disable your account if we determine, at our sole discretion, that you have violated any provision of this Agreement or that your conduct or content tends to damage our reputation and goodwill. If your account is disabled for a violation of these terms, you are strictly prohibited from re-registering for any of our Services under any brand name.

Section 02

Uptime Policy

We strive to provide a high level of service availability, aiming for 99.9% uptime across our hosting services.

Exclusions: This goal excludes downtime resulting from scheduled maintenance, emergency maintenance, or circumstances beyond our reasonable control (including, but not limited to, upstream provider outages, DDoS attacks, or DNS propagation issues).

Uptime is calculated on a per-calendar-month basis.
In the event that service availability falls below 99.9% in a given month, reparations (such as pro-rated account credits) may be considered on a case-by-case basis.
To be considered for a credit, you must submit a support ticket within seven (7) days of the end of the month in which the downtime occurred.

Section 03

Money-Back Guarantee

We offer a 14-day money-back guarantee for new, non-promotional hosting and email packages. To request a refund, please contact our support team via our website within 14 days of your initial purchase.

            Please note: Domain name registrations, transfers, and cryptocurrency transactions are strictly non-refundable. Additionally, if you are found in violation of this Agreement, all refunds will be rendered void. The 14-day money-back guarantee does not apply to digital downloads or knowledgebase files. All sales for downloadable products from MakeMyKB are final once the order has been accepted.
        

Section 04

Account Security

You are responsible for maintaining the security of your account, including the use of strong, unique passwords and regularly updating them. Enabling two-factor authentication (2FA) is strongly recommended where available.

You are fully responsible for all activities that occur under your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Providing false contact information of any kind may result in the immediate termination of your account.

Section 05

Acceptable Use Policy

Users of DragonWebHost services agree not to engage in any illegal activities, resource abuse, or spam. The following activities are strictly prohibited:

Sending unsolicited bulk emails (spam), including bulk marketing emails regardless of opt-in status.
Engaging in any form of illegal activity, including but not limited to copyright infringement, child exploitation, and distribution of malware.
Abuse of server resources, including excessive CPU usage, memory usage, and disk space consumption.
Participation in forums or communities that share and/or trade compromised personal data (leak forums).
Participation in forums or communities that share and/or trade pornographic material.
Sending bulk emails to @qq.com email addresses.
Deceptive use against third party services, such as signing up for numerous accounts using a catchall and randomly generated email aliases.
Engaging in bulk forwarding for multiple domains.
Sending SMS messages via email.
Utilizing "warmup" services.
Sending an excess of junk emails that are not intended for human consumption to third party email services.
Engaging in activities that lead to IP address reputation damage.
Spoofing "From" headers to display a third party or domain that you do not own or manage.
Storing website files, databases, or other media that are not related to email inside email hosting packages.
Adding domains to our system that are not legitimate, not managed by you, or related to any spam/scam activity.
Sending through our outbound email service without valid SPF and MX records.
Creating additional accounts to circumvent the 400 outbound emails per hour limit.
Redistributing, reselling, or publicly sharing downloadable content or knowledgebase files provided via MakeMyKB without prior written consent is strictly prohibited.

Zero Spam Policy: Outgoing spam is strictly prohibited. All mailing lists must be double opt-in. Intentional unsolicited marketing emails will be billed at a rate of £1 per email. Violations of the AUP may result in termination without prior notice.

Section 06

Payment Terms

All payments for services rendered must be made promptly. We accept PayPal, Debit/Credit Cards, Cryptocurrency, and UK Bank Transfer.

Chargebacks: If you dispute a charge or initiate a chargeback, DragonWebHost reserves the right to suspend or terminate your account immediately. Chargebacks are taken seriously and may lead to a permanent ban from all our services.

Section 07

Support Policy

Support inquiries should be submitted via email or our Support Ticket system. While we aim to address high-priority issues (outages/system failures) within 24 hours, we do not guarantee specific wait times.

Support abuse: Bumping tickets, creating multiple tickets for the same issue, exhibiting rude behaviour, or making threats will be considered an abuse of support and may result in restricted support access or account termination.

Section 08

Data & Backups

While we strive to maintain backups of your data, we do not guarantee their availability or integrity. It is your sole responsibility to maintain local copies of your data and important files. DragonWebHost is not liable for any data loss.

Section 09

Intellectual Property & Digital Products

All content provided through the Services, including but not limited to knowledgebase files, is the intellectual property of MakeMyKB. You may not reproduce, distribute, or create derivative works based on our content without prior written consent.

Section 10

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Michael Cooper, DragonWebHost, or its affiliates be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Services.

Section 11

Indemnification

You agree to indemnify and hold Michael Cooper and DragonWebHost harmless from and against any claims, damages, losses, and expenses, including legal fees, arising out of your use of the Services or your violation of this Agreement.

Section 12

Termination & Changes

We reserve the right to terminate services at any time, with or without cause. We also reserve the right to modify these Terms of Service at any time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the new terms.

Section 13

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
